No line exists between academia and advocacy in the IP world.
A few purely scholarly enterprises exist, but most academic institutions are
advocates for the “communitarian” view that IP rights need to be substantially
reduced in the light of new technologies, and that production mechanisms based
on peer-to-peer sharing are, and should be, supplanting market-based mechanisms.
A few are “propertarian,” maintaining the view that property rights provide the
best mechanism for organizing productive activity. Non-academic institutions
are similarly split. Of course, there are vast differences in degree within
the categories, from slight tilts in one direction to all-out advocacy. And advocacy
is not inconsistent with honest analysis.
The most scholarly work is done in connection with patents, by people who take
the fundamentals of the current patent systems as a given, and analyze possible
adjustments.
